Terms of Use

Introduction

Welcome to LastDevOps LLC ("LastDevOps", "we", "our", "us"). These Terms of Use ("Terms") govern lastdevops.com, Last DevOps Academy, webinars, coaching, and related services we provide on or through this website.

Your agreement: by using this site, registering for a webinar, joining the community, or purchasing coaching, you agree to these Terms. If you do not agree, do not use the services.

Applicant (separate product)

LastDevOps Applicant at applicant.lastdevops.com is a separate product. Use of Applicant is governed by the Applicant Terms of Use and the Applicant Privacy Policy. These Terms apply to this website, Academy, webinars, and coaching — not to Applicant practice accounts, audio, or AI feedback.

Who can use the services

You must be at least 18 years old. We do not provide services to children. By accepting these Terms you confirm that you meet this requirement. If we learn that a user is under 18, we may end access and delete their data.

What we provide

• This website (information and marketing)
• Last DevOps Academy and community, hosted on Skool
• Live webinars, hosted on Google Meet
• Coaching, which may include SimpleApply (Coach) for job-application support
• LastDevOps Applicant — interview practice — under its own terms

We do not guarantee a job, interview, salary, visa, or any particular career outcome. Training and coaching are educational.

Third-party platforms

Parts of the service run on third-party platforms. When you use those platforms, their terms and privacy policies also apply:

We are not responsible for a third party's availability, content, or independent processing, except as required by law.

Webinars

You register with your full name and email. Sessions run on Google Meet. Joining details go to the email you give us. We may cancel, reschedule, or change format. If we record a session, we will say so at or before the webinar.

Community (Skool)

Academy community lives on Skool. We share your full name and email with Skool so you can join. Follow Skool's rules and any community rules we post. We or Skool may remove access for abuse or Terms violations.

Coaching

Coaching is a professional service, not employment or a placement guarantee. To fulfill coaching we share your full name, email, address, phone number, and resume with SimpleApply (Coach) so applications can be submitted as part of the engagement. You must provide accurate information. Enrolling in coaching that uses SimpleApply is your authorization for that sharing.

Payments

Academy membership is billed through Skool under Skool's terms. Coaching fees, billing, and any refunds are as disclosed at purchase. Taxes may apply.

Acceptable use

You agree to use the services only for lawful purposes. You may not:

• Damage, overload, or impair our systems or other users' enjoyment
• Attempt unauthorized access to systems or data
• Create a false identity to mislead others
• Transmit illegal, infringing, or malicious content
• Share paid Academy or coaching materials beyond the license we grant
• Violate applicable laws

Intellectual property

Site and Academy content (curriculum, branding, software, materials) is owned by LastDevOps or its licensors. You receive a limited, non-exclusive, non-transferable license for personal, non-commercial educational use of materials we provide, for as long as you have access.

You retain ownership of original content you create (for example your resume). You grant us a license to process that content as needed to operate the services, including sharing it with SimpleApply when coaching requires it.

Privacy

Your use is also governed by our Privacy Policy, which is incorporated by reference.

Electronic communications

You agree to receive service-related email (webinar links, coaching logistics, community access). Marketing email includes an unsubscribe path where required.

Changes to these Terms

We may update these Terms. We will update the Effective Date when we do. Continued use after changes constitutes acceptance where permitted by law.

Termination

By you: stop using the services; for Academy, leave or cancel via Skool as that platform allows.

By us: we may suspend or terminate access for violation of these Terms, risk to the service, or other legitimate reasons, with or without notice where permitted.

Disclaimer of warranty

To the maximum extent permitted by law, the services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation. Third-party platforms may fail or change. We do not warrant career outcomes.

Limitation of liability

To the maximum extent permitted by law, LastDevOps LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or use. Our aggregate liability for claims relating to the services shall not exceed the fees you paid to us for the services in the twelve months before the claim (or USD $100 if you paid nothing).

Indemnification

To the fullest extent allowed by law, you agree to indemnify and hold harmless LastDevOps LLC and its affiliates, officers, and agents from claims arising out of your use of the services or violation of these Terms.

Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules. Courts in Texas have exclusive jurisdiction, except where mandatory consumer protections in your country require otherwise.
